Live course · Begins Tuesday, December 1 · 12 sessions · Prerequisite: Honor With Equity, prior or alongside
Why most trusts fail, and how to build one that holds.
The Equity Trust System is JD and Margaret Swan's 12-week live course on building a pure, irrevocable, non-statutory trust: holding property outside your name, passing it on without probate, and keeping private affairs private while you still do business in the public.
Tuesdays 6:00 PM Eastern · Lifetime recordings · Free attendance at every future series
Your name on everything is the exposure nobody warns you about
Everything held in your own name can be claimed as yours: by a creditor, a court, a tax agency, or a probate judge who publishes your family's business in a public file for nine to twenty-four months and pays the lawyers first. Prince's estate took six years. James Brown's took about fifteen.
Most people who try to fix this buy a trust that does not hold. The revocable living trust is still you for every purpose that matters. The trust where one person wears every hat is pierced the first time a court looks at it. The offshore trust registered with a government is still statutory. The courts that set those trusts aside did not misunderstand them. They saw exactly what they were.
What you will be able to do by session 12
- 1Form a trust in Equity, irrevocable and non-statutory, that rests on the right to contract.
- 2Recognize and avoid the structural elements that void protection, including the ones most attorneys build in.
- 3Create layered separation across entities so a difficulty in one cannot reach another.
- 4Draft the documents that convey assets into the structure.
- 5Operate through your entities: bank accounts, business, and credit, lawfully.
- 6Establish private member associations and self-supporting ministries where your situation calls for them.
- 7Pass assets across generations outside probate, estate tax exposure, and public record, with your values written into the indenture.
