Maxims of Equity


There are maxims in Equity. These are not a rigid set of rules but are general principles. They are inarguable. To violate a maxim, is to come out of Equity.

Two important maxims are:
“One who seeks Equity must do Equity.”
"One who comes into Equity must come with clean hands."

Important notes on this:
1) if you are bringing Equity, you must know how to stand on the rock with it through out; and
2) if you are seeking an Equitable remedy, then you must not mix the Equity process with any other process out there.
